Army Military Justice Procedure
Army military justice applies the UCMJ and current Manual for Courts-Martial through Army-specific regulations, Trial Judiciary practice, public court-martial records, and Army appellate rules.
Authority stack
- Army Trial Judiciary / AR 27-10 resources
- Army Court-Martial Public Record System
- Army Court of Criminal Appeals
Service procedure
- Start with the current UCMJ and MCM, then identify the current AR 27-10 version and any Army interim update affecting the issue.
- Identify the responsible command, legal office, Special Trial Counsel role where applicable, preliminary-hearing authority, and court-martial forum.
- Use Army Trial Judiciary resources for trial practice, magistrate materials, Benchbook resources, search/seizure forms, and rules.
- Use the Army Court-Martial Public Record System for Article 140a public docket/record research; do not treat a charge or docket entry as a finding of guilt.
- Use ACCA rules and the appellate library for Army appellate procedure, opinions, records requests, and hearing information.
Records to preserve
AR 27-10 version used; orders/status records; DD Form 458 and amendments; Article 32 materials; trial-judiciary orders/rulings; public docket captures; record of trial; ACCA docket, briefs, orders, opinions and mandate.
Do not transfer service rules
The UCMJ and MCM are common foundations. Service regulations, court rules, filing systems, trial-judiciary practices and administrative routing are not interchangeable. Verify the member’s service, status, forum and date before applying a service-specific rule.
