MJ-019: Appellate review is forum- and posture-specific: service Courts of Criminal Appeals, CAAF, and Supreme Court review have distinct jurisdiction, filing rules, and deadlines.

Working procedure

  1. Identify the service, judgment date, post-trial action, and appellate status.
  2. Identify whether review is automatic, waived, petition-based, referred, interlocutory, victim mandamus, government appeal, or extraordinary writ.
  3. Use the current rules of the correct CCA and CAAF for the filing date.
  4. Preserve notices, docket number, briefs, motions, orders, opinions, mandates, and proof of filing/service.
  5. Treat petitions for new trial, correction-board relief, clemency, and collateral review as separate lanes unless authority expressly connects them.

Version and service discipline

Military justice is version-sensitive. Match the offense date, procedural date, service, forum, and filing date to the governing statute, MCM/R.C.M./M.R.E. version, presidential amendments, service regulation, and court rules. The 2024 MCM must be checked against later operative amendments before treating it as complete current procedure.
