Working procedure
- Identify the correct service appellate court and docket number before researching filings or opinions.
- Determine the statutory path: Article 66 review, Article 62 government appeal, Article 69 referral/application, Article 6b petition, new-trial matter or extraordinary writ.
- Use the court’s current rules for filing date, format, service, motions, oral argument and record access.
- Preserve briefs, motions, orders, opinions, mandates and proof of filing or service.
- Separate unpublished or nonprecedential dispositions from published precedential opinions under the court’s own rules.
Records to preserve
Appellate docket; notices; assignments of error; briefs; motions; orders; oral-argument notices or recordings; opinions; mandate or final court action.
Version control
Match the offense date, procedural date, service, forum and filing date to the governing UCMJ text, MCM/R.C.M./M.R.E. version, later presidential amendments, service rule and court rule. The 2024 MCM remains the current published edition, but later operative amendments must be checked before treating it as complete current procedure.
