Part IV research status

All 94 statutory punitive-article table entries now have a first-pass Part IV source/status record. The registry identifies the current MCM paragraph or omitted status, elements-research status, Article 79 / Appendix 12A treatment status, maximum-punishment status, effective-date/version caveats, and appellate-authority status. A completed first pass does not mean every theory-specific punishment or controlling appellate case has been fully transcribed; those fields remain expressly marked where deeper verification is still required.

For the current 2024 MCM, Executive Order 14130 must be applied as a post-publication overlay. The punitive registry specifically flags its Part IV changes to Article 119a (paragraph 58) and Article 128b (paragraph 78a), while preserving conduct-date and savings-clause analysis for every offense.

What this index establishes

  • Current statutory numbering and title: based on the current preliminary U.S. Code table indexed through September 2026.
  • Stable registry identity: each entry has an MJPA ID in the MilitaryClaims Source of Truth Registry.
  • Version control: the registry separately tracks whether elements, lesser-included offenses, maximum punishment, and appellate authority have been transcribed and verified.

Do not use the article title alone to charge, defend, evaluate, or sentence a case. The governing elements, definitions, defenses, LIO treatment, maximum punishment, sentencing regime, and case law can depend on the offense date and current MCM/amendment set.

Numbering traps

  • Article 120a: the current title is Mails: deposit of obscene matter. Older materials may identify stalking as Article 120a.
  • Article 130: stalking is the current statutory article.
  • Articles 104a and 104b: older pre-2019 materials may use former Article 83/84 numbering for enlistment/separation offenses.
  • Article 129a: the current Code table marks it omitted.
  • Article 134: statutory text is not a complete list of enumerated MCM offenses; current MCM/amendments must also be checked.

The new Punitive Articles registry tab contains separate fields for MCM Part IV, elements, lesser-included offenses, maximum punishment, effective-date/version caveats, and appellate authority. Those fields are intentionally marked not yet transcribed until each article is checked against the current MCM and later operative amendments. This prevents a 2024 table or an older article number from being silently treated as current law.
